Overview

Anthony Cole’s practice focuses on financial crime investigations and compliance, with a particular emphasis on anti-corruption, anti-money laundering, fraud and economic sanctions matters. He is the national co-leader of Dentons’ Global Compliance and Investigations group, and is widely recognized as a leading lawyer in the investigations space in Canada.

In the area of anti-corruption, Anthony has acted as counsel in precedent-setting cases in Canada, representing clients across a range of industries in connection with criminal investigations, prosecutions, civil recovery measures and forfeiture proceedings. Notably, Anthony acted as counsel on the successful negotiation of the first ever Deferred Prosecution Agreement in Canada on a case involving offences under Canada’s Corruption of Foreign Public Officials Act.

Anthony has vast experience with internal investigations for corporate clients, including both domestically-focused matters and cases spanning multiple jurisdictions. He frequently acts in relation to compliance mandates or investigations pertaining to allegations of fraud, bribery, money laundering, insider trading, economic sanctions and modern slavery laws, and has substantial experience with multi-jurisdictional cases, including those engaging the US Foreign Corrupt Practices Act and UK Bribery Act 2010. Anthony often works alongside colleagues from other jurisdictions to manage and navigate the complex issues that can arise in cross-border cases, and he has advised clients in responding to search warrants, production orders and mutual legal assistance treaty (MLAT) requests, and has handled contested applications relating to the assertion legal privilege in multi-jurisdictional matters. In advising clients on such cross-border matters, Anthony is able to draw on his substantial prior experience of practicing as a lawyer in England as well as Canada.

Anthony has also represented clients in civil litigation and arbitration proceedings, and has acted for clients in international arbitration proceedings (including ICSID) involving corruption allegations and economic sanctions issues. He has experience with emergency interim relief such as Mareva injunctions, Norwich Pharmacal orders and Anton Piller orders.

Anthony also conducts risk assessments, compliance reviews and training, and regularly advises on the development of business integrity policies and procedures. Anthony is also a Certified Anti-Money Laundering Specialist (CAMS), and has substantial experience with conducting counter-party risk assessments, including value-chain due diligence and risk mitigation advice.
